It is common for an outgoing President to issue pardons before he leaves the White House, but can Trump pardon himself? That is the subject of a major debate because it has never been attempted before. But this is 2020, when anything is possible.
New York Attorney General Letetia James thinks it’s more likely that Trump will step down, invoking the 25th Amendment and acting President Mike Pence could pardon him instead. Listen to what she said on the View on Tuesday.
.@NewYorkStateAG @TishJames tells @TheView she suspects Pres. Trump “will step down and allow the vice president to pardon him” before the end of his term as she says the “vast majority of legal scholars have indicated that he cannot pardon himself.” https://t.co/f8u2wbJuik pic.twitter.com/xeJwNtA4eH

Even if Trump is granted a Federal pardon, he cannot avoid justice in the State of New York, according to AG James.
She opened an investigation into his businesses last year after Trump’s lawyer Michael Cohen testified that the president inflated his assets and financial statements.
If James and her team find any criminal activity, the State of New York will move forward with charges, even if Trump is pardoned.
There is a new law in New York that allows state charges to be pursued against an individual who has already received a pardon for a federal conviction.
“I’m so happy they passed that bill and it is now the law in the state of New York,” James said on the View. “President Trump cannot avoid justice in the great state of New York.”
