Judge Tosses Comey and James Indictments Over Illegal Prosecutor Appointment
Written by DJ Sight on November 25, 2025
A judge threw out the criminal cases against James Comey and Letitia James because the prosecutor, Lindsey Halligan, was not legally appointed and had no authority to bring the charges.
Since she was the only prosecutor involved, the judge said everything she did — including the indictments — is invalid.
The cases were dismissed without prejudice, meaning they could be brought again. But Comey’s lawyers say that’s impossible now because the time limit for charging him has already run out.
The Justice Department disagrees and plans to appeal.
Comey and James said the charges were political. Legal experts say it will be hard for the government to revive the cases.
