Xerox FCU Robbery Suspect Could Face Death Penalty

(WHEC News 10) – Will the man accused of killing a customer during a 2003 Xerox Federal Credit Union robbery face the death penalty? We expect federal prosecutors to talk about that in front of a judge Monday morning.

Prosecutors say Richard Wilbern walked into the credit union in Webster 13 years ago, robbed it, and shot two men. In this hearing we expect the sides to discuss whether or not the death penalty will be on the table in this case. Federal prosecutors tell us due to the circumstances surrounding this charge, they have the option to pursue this as a capital case. About a month ago, they told us the Department of Justice would make a decision by around mid-November.

Prosecutors say in 2003, Wilbern robbed the Xerox Federal Credit Union in Webster.

He’s accused of shooting two men during that robbery. One of them, Raymond Batzel, died.

He was a customer at the credit union that day. This was a case that left a lot of us with questions for 13 years, until an arrest finally came back in September.

Wilber will be in court today around 9:30 Monday morning.
