Leticia Astacio Sentenced to 180 Days in Jail

Former Rochester City Court Judge Leticia Astacio was sentenced to 180 days in jail by Ontario County Judge Lisa Toole on Tuesday morning, after she plead guilty to violating her parole on multiple occasions.

This sentencing is connected to a 2016 DWI charge where Astacio admittedly violated the terms of her probation, claiming her prior convictions were illegal. In addition to being removed from the bench, the DWI charge led to her spending four months in jail, a year of conditional discharge and two years of probation.

Astacio, who now works as an attorney and represented herself in court, argued that she should get sentenced with time served due to her charge being a misdemeanor DWI. However, Judge Toole did not agree.

In the judge’s own words to Astacio: “You unilaterally decided to take yourself off of probation,” Toole said. “Your actions show you didn’t want to go anymore, so you just stopped going. I’m not happy about it. I’m not going to tolerate it. Your actions show you do what you want to do when you want to do it, and it stops today, and it stops now.”
