Kansas Court of Appeals Say Common Law Protects Healthcare Providers from Being Sued for Not Keeping Medical Records Confidential

Kansas Court of Appeals says healthcare providers are not required to keep your medical records confidential under common law.

This decision came after a lawsuit against the University of Kansas Medical Center where a female patient went to Jay doc free clinic in April of 2021. The patient agreed to let 2 medical students join the exam.

The doctor performed a pelvic exam, took pictures and sent them to both medical students’ phones.

The patient confronted the Doctor and he admitted to sending the photos.

The lawsuit, first heard in Wyandotte County District Court, was dismissed upon the request of The University of Kansas Medical Center.
