Supreme Court upholds birthright citizenship, firmly rejecting Trump’s executive order

The Supreme Court upheld a broad conception of birthright citizenship, rejecting President Trump’s executive order declaring that children born to parents who are in the United States illegally or temporarily are not American citizens. The justices relied on a long-settled understanding of the 14th Amendment, adopted after the Civil War, ruling that anyone born in the country, with very limited exceptions, is a citizen. Five justices formed the majority, with Justice Brett Kavanaugh agreeing the order was invalid but for a different reason. The ruling firmly rejected the executive order Trump issued on the first day of his second term. Trump responded by saying it was “too bad” and pushed for legislation to end birthright citizenship through Congress. The decision was the final ruling of the court’s 2025-26 term and is expected to affect immigration policy and enforcement going forward.
