New York law now prevents employers from checking your credit scores
Written by Site Hub on April 19, 2026
A new New York State law that prohibits most employers from checking the credit scores of job applicants or current employees has taken effect. The law, which was signed by Gov. Hochul, is intended to remove a barrier to employment that consumer advocates and civil rights organizations have long argued disproportionately affects lower-income workers, people of color, and those who have experienced financial hardship due to medical debt, divorce, or other circumstances beyond their control. Certain exemptions apply for positions in law enforcement, financial services, and roles where credit checks are required by federal or state regulations. New York joins a growing number of states and cities that have restricted the use of credit history in hiring decisions. Employers who violate the new law could face penalties from the state Department of Labor.
