Lawmakers Review Bill to Extend New York Road Damage Liability
Written by DJ Sight on April 7, 2026
New York lawmakers are considering the SAFE ROADS Act, introduced by James Skoufis, which would make the state liable for road defects year-round instead of only from May to November.
The bill allows people to seek damages for injuries caused by dangerous road conditions but includes exceptions, such as snow and ice on otherwise safe roads, construction issues, and certain bridge damage. To win a claim, individuals must prove the state was negligent or had prior notice of the hazard.
The proposal is currently under review in the New York State Senate Transportation Committee.
