City of Rochester files appeal to restore Police Accountability Board’s investigative powers

The City of Rochester is appealing a recent court ruling that stripped the Rochester Police Accountability Board of its investigative powers. The appeal, filed in state court, seeks to reverse the decision that left the PAB with only the ability to exist as an entity and to make policy recommendations to the Rochester Police Department. The original ruling, brought by the Rochester Police Locust Club union and upheld by the Fourth Division Court of Appeals in March, found that the PAB did not have authority to investigate misconduct, subpoena officers, access police databases, or review body-worn camera footage. PAB Executive Director Dr. Lesli Myers-Small has said the board remains committed to pursuing every lawful avenue to serve Rochester residents. The appeal signals that the city administration is not ready to concede the board’s investigative function permanently.
